State paid leave maximum weekly benefit amounts in 2023

Each state that has a paid family leave program sets a maximum amount of wage replacement benefits that an employee on leave may receive from the state. The weekly benefit is calculated differently in each state, but in all states, the more an employee earns in wages, the higher the weekly benefit.

The maximum benefit amount varies from state to state. Every state has a mechanism in place to automatically adjust the maximum benefit for inflation each year. Some states make the adjustment as of January 1 and others do so in the middle of the year.

Here are the maximum benefit amounts under the paid family leave programs currently in place for 2023:

California

The maximum weekly benefit for 2023 is $1,620. The amount is adjusted on January 1 each year.

Colorado

Colorado’s paid family leave law goes into effect on January 1, 2024. The maximum weekly benefit for 2024 will be $1,100. After 2024, the maximum weekly benefit is adjusted each year to 90% of the statewide average weekly wage. Colorado adjusts its statewide average weekly wage effective July 1 each year. The statewide average weekly wage was raised to $1,421.16, but pursuant to the law, the maximum average weekly wage for paid family leave benefits will remain at $1,100 throughout 2025. The next adjustment to the average weekly wage should occur on January 1, 2026 and then every July 1 thereafter.

Connecticut

The maximum weekly benefit is $900. The maximum amount is based on the CT minimum wage multiplied by 40. CT’s minimum wage is adjusted each year on January 1.

District of Columbia

The maximum weekly benefit as of October 1, 2023, is $1,118. The amount is adjusted each year on October 1.

Maine

Maine’s paid family leave program will launch in 2026. The maximum weekly benefit will be the state average weekly wage and will be adjusted each year on January 1.

Massachusetts

The Massachusetts maximum benefit amount for 2023 is $1,129.82. The amount is adjusted each year on January 1.

Minnesota

Minnesota’s paid family leave benefit will launch in 2026. The maximum weekly benefit amount has not been announced. The maximum weekly benefit amount will be the state’s average weekly wage. The state average weekly wage is currently $1,337 and is adjusted effective October 1 each year.

New Hampshire

New Hampshire’s maximum weekly benefit is the Social Security wage cap, which is $160,200 in 2023 and adjusted each year effective January 1.

New Jersey

New Jersey’s maximum weekly benefit for 2023 is $1,025 and is adjusted each year effective January 1.

New York

New York’s maximum weekly benefit amount for 2023 is $1,131.08. The amount is adjusted each year effective January 1.

Oregon

Oregon’s maximum weekly benefit amount is $1,523.63. The benefit amount is 120% of the state average weekly wage and is adjusted effective July 1 each year.

Rhode Island

Rhode Island’s maximum weekly benefit amount is $1,043. The amount is adjusted effective July 1 each year.

Washington

Washington’s maximum weekly benefit amount for 2023 is $1,423. The amount is adjusted effective January 1 each year.
